Terms of Service
Effective September 9, 2026. These terms govern your use of thepoolcrm.com and the services BJG Digital provides, including the PoolCRM software subscription and done-for-you marketing services.
1. Who we are
BJG Digital ("BJG," "we," "us") is a marketing and software company based in Arizona. PoolCRM is a product of BJG Digital. You can reach us at (480) 568-1983.
By using our websites, booking a call, or purchasing a subscription or service, you ("you," "Customer") agree to these terms. If you are signing up on behalf of a business, you confirm you have authority to bind that business.
2. What we provide
- PoolCRM. A customer relationship and messaging system for pool service companies, configured and hosted by BJG on the GoHighLevel platform. It includes missed call text back, quote follow up sequences, review request automation, two-way texting, web chat, and a lead pipeline.
- Marketing services. Website design, advertising management, and Google Business Profile work, as described in a written proposal or order we send you.
- Setup. For PoolCRM, we configure the system on your business phone number and Google Business Profile. You provide a logo, phone number, and profile link. Setup is typically complete within 3 business days of receiving those items.
3. Accounts
You are responsible for keeping your login credentials confidential and for all activity under your account. Tell us right away if you believe your account has been accessed without permission.
You must be at least 18 and operating a business to use our services.
4. Fees and billing
- PoolCRM subscription: $397 per month, billed in advance on the same day each month to the payment method you provide. Your first payment covers setup and your first month of service. There is no separate setup fee.
- Marketing services: fees are set in your proposal and billed monthly in advance unless the proposal says otherwise.
- Advertising spend is paid by you directly to the advertising platform (Google, Meta, and similar). We do not mark up ad spend and it is not included in our fees.
- Messaging and phone usage. PoolCRM includes a reasonable allowance of text messages, calls, and emails for a typical pool service company. If your usage is far above typical, we will tell you and agree on any additional cost before charging it.
- Late or failed payment. If a payment fails, we will retry it and notify you. If it remains unpaid for 10 days, we may suspend service until it is paid.
- Taxes. Fees do not include sales or similar taxes. If any apply, they are added to your invoice.
5. Cancellation and refunds
PoolCRM is month to month. You may cancel at any time by calling or texting us or by emailing the address on your invoice. Cancellation takes effect at the end of the current billing period. You keep access until then.
We do not prorate or refund partial months. If you cancel during your first 30 days and we have not completed setup, we will refund your first payment in full.
Marketing services follow the notice period in your proposal. If the proposal is silent, either party may end services with 30 days written notice.
6. Your responsibilities when messaging your customers
PoolCRM sends text messages, calls, and emails to your customers and leads on your behalf, from your business number. You are the sender of those messages. You agree to:
- Obtain and keep any consent required to contact your customers and leads, including consent required under the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, state law, and mobile carrier rules.
- Honor opt-out requests promptly. PoolCRM automatically processes STOP replies, but you must not re-add someone who has opted out without new consent.
- Not send content that is illegal, deceptive, harassing, or that violates carrier messaging policies.
- Provide accurate business registration information if we need it to register your phone number for business texting (10DLC or similar).
You are responsible for the content and legality of messages sent through your account. We may pause messaging on your account if we receive complaints or a carrier or platform requires it.
7. Third-party platforms
Our services are built on and connect to third-party platforms, including GoHighLevel, Cloudflare, Google, Meta, and telephony providers. Your use of those platforms is also subject to their terms. We are not responsible for outages, changes, or actions taken by those platforms, but we will work to restore service and tell you what happened.
If you connect PoolCRM to other software (Skimmer, Pool Brain, Jobber, QuickBooks, Zapier, and similar), you are responsible for those accounts and their terms.
8. Your data
Your customer list, contacts, conversations, and business data belong to you. We use them only to provide and improve your service and as described in our Privacy Policy.
You can request an export of your contacts and conversations at any time while your account is active and for 30 days after cancellation. After that, we may delete your data.
Aggregated, anonymized usage statistics (for example, average response rates across all customers) may be used to improve the product and in our marketing. They never identify you or your customers.
9. Our intellectual property
The PoolCRM configuration, automations, message templates, website designs, and related materials are owned by BJG Digital. Your subscription gives you a license to use them for your business while your account is active. You may not copy, resell, or share them with other businesses.
Websites we build for you are yours once paid in full, except for any third-party components licensed separately. We may show work we did for you in our portfolio unless you ask us not to.
10. No guaranteed results
We build systems that help pool companies capture more leads, follow up faster, and earn more reviews. Results depend on your market, your pricing, your service, and how you use the tools. We do not guarantee any particular number of leads, jobs, reviews, or revenue. Any figures on our websites are examples or historical results for specific customers, not promises.
11. Disclaimers and limitation of liability
Our services are provided "as is." To the fullest extent allowed by law, we disclaim all warranties, express or implied, including fitness for a particular purpose.
To the fullest extent allowed by law, BJG Digital is not liable for indirect, incidental, consequential, or lost-profit damages arising from your use of our services. Our total liability for any claim is limited to the fees you paid us in the three months before the claim arose.
Some states do not allow certain limitations, so some of these may not apply to you.
12. Indemnification
You agree to defend and hold BJG Digital harmless from claims arising out of messages you send through our services, your content, your violation of these terms, or your violation of any law or third-party right.
13. Suspension and termination
We may suspend or end your account if you breach these terms, if your usage threatens the service or other customers, or if a platform or carrier requires it. We will tell you why and give you a chance to fix it where practical.
14. Governing law and disputes
These terms are governed by the laws of the State of Arizona without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Maricopa County, Arizona, and you consent to that venue. Before filing, both parties agree to try to resolve the dispute by talking it through in good faith for 30 days.
15. Changes to these terms
We may update these terms from time to time. If a change materially affects you, we will notify you by email or text at least 15 days before it takes effect. Continued use after that date means you accept the change.
